亞馬遜、eBay賣家如何與GBC和解？史上最全GBC和解流程

跨境賣家與GBC和解的全過程：

1)被告賣家聯(lián)系律師，將自己的信息，包括ebay賬號、凍結paypal賬號、金額、售賣產(chǎn)品的信息發(fā)給律師。

2)律師轉(zhuǎn)發(fā)賣家郵件給GBC的兩位女將，可能也發(fā)給女將的頭頭Justin，郵件內(nèi)容非常簡單，例如 Let's resolve。

Attached please find evidence pertaining to your client’s eBay store integritxxx, which was offering products bearing counterfeits of at least Tory Burch’s registered TT logo trademark. Our records indicate that this store is associated with one PayPal account with a total of approximately $1,632.56 restrained. Please confirm.

To consider settlement, our client requires the following information:

·The name of the individual and/or company that owns and operates the Internet Stores, and the address of that individual and/or company,

·A complete accounting of sales, including corroborating documentation supporting your representation of the number of units sold and the total revenue generated,

·Supplier information; and

·Documents evidencing clearance procedures implemented by your client prior to listing products for sale, including procedures for verifying that products are authorized.

Please note, we have no extension agreement in place regarding the response deadline and any extension request must be explicitly made in writing and prior to the response deadline.

逐一說明下：

第一個問題：ebay id的所有者的姓名或者公司名，還有地址

第二個問題：侵權產(chǎn)品銷售歷史記錄，可以是一個訂單截圖，也可以簡單回答I sold 2

第三個問題：供應商信息，例如1688網(wǎng)址等

第四個問題：發(fā)票?授權書?或者其他解釋性文字

I was selling unbranded product, and depend on Alibaba, since Alibaba doesn’t allow to sell fake product, I know selling fake is illegal and tried to avoid.

4)賣家把回答回復律師，律師轉(zhuǎn)發(fā)給GBC。

5)GBC收到后會開一個和解條件，你會收到GBC一封很長的郵件，其他都忽略，看這部分即可：

In light of the above, Christian Dior is willing to settle this matter for $10,000 via wire transfer. It is also well under the maximum award available for non-willful conduct pursuant to 15 USC Section 1117(c).

上面的郵件GBC要求10000usd和解，當然他們附件里面的和解pdf文件也會寫的很清楚。

6)如果賣家同意和解，打印和解書最后一頁，按如下簽字，用手機拍照或者掃描，作為附件回復郵件給律師，律師再傳給GBC：

7)GBC通知Paypal撤訴，之后Paypal會發(fā)信給你說你的賬號恢復了，但是Paypal會做一個二次審核，對于一些比較小或者侵權比較嚴重的賣家(尺度很主觀，完全看Paypal安全組的人怎么看)，Paypal會永久凍結賬號。

8)賣家支付律師費用。

幾個要點：

1)GBC只會理他們認為有必要搭理的人，如果賣家給GBC寫信，他們會忽略，有些律師給GBC寫信，GBC也不會搭理，要找和GBC打過交道的律師。

2)整個和解過程涉及4方：賣家、律師、GBC和Paypal，一個案件發(fā)生后，如果賣家拖延會錯過最佳的和解時間;如果律師太忙沒有及時發(fā)送你的信息給GBC也會延誤案件處理;GBC也有可能忘記處理你的案件，所以和解過程，賣家一定要不停地催(push)，不要說我交給你處理了，我就不管不問了，很多環(huán)節(jié)可能出問題。

3)案件處理，如果沒有延誤，第一天發(fā)信息給GBC，第二天收到GBC的問題、回復問題答案，第三天收到GBC的條件，如果賣家同意簽字割地賠款，第四天Paypal恢復，快的話一周內(nèi)搞定。

4)和解比例：跟侵權的嚴重程度有關，跟你處理的時間有關，如果你處理的很晚，快到期了，GBC要求的比例會很高，目前看一般GBC會要求70%左右，他們會取一個500的整數(shù)，比如凍結5300，要求拿3500。

5)如果被凍金額太少，比如500usd，GBC會開很高的條件和解，比如10000usd，當然律師可以跟他們還價，但是一般要2000usd以上，你通過銀行轉(zhuǎn)賬打給GBC，所以如果你發(fā)現(xiàn)你的產(chǎn)品被GBC買了，而且的確侵權，那么留個1000-2000usd被他們凍結，然后去和解。
